Occupational Safety and Health Responsibilities: A Shared Commitment for Business Sustainability
In a business environment that is increasingly demanding and exposed to a wide range of operational risks, Occupational Safety and Health (OSH) plays a strategic role in ensuring not only the protection of employees, but also the continuity and sustainability of businesses. In this context, Peruvian legislation establishes that preventive management is not solely the employer’s responsibility; it is rather a shared responsibility between employers and employees.
Far from being viewed as a mere formal obligation, compliance with OSH responsibilities should be regarded as a key component of business management, aimed at preventing workplace accidents, occupational illnesses, and legal contingencies that may affect the operations and reputation of a company.
From a regulatory standpoint, Law No. 29783, the Occupational Safety and Health Law, establishes the employer’s duty to ensure safe working conditions, which includes implementing preventive measures, identifying hazards, assessing risks, and adopting appropriate control measures. Moreover, the law recognizes the active participation of employees as a fundamental component of the OSH Management System, promoting a culture of prevention based on cooperation.
Within this framework, the employer assumes a leadership role in OSH management. This involves not only implementing the OSH Management System, but also providing the necessary resources, training personnel, and continuously monitoring compliance with safety measures. The employer’s responsibilities also include the timely identification of risks, the investigation of incidents, and the continuous improvement of preventive processes, ensuring that working conditions do not pose a risk to the life or health of employees.
In turn, employees play an equally important role within the preventive framework. Their active participation includes complying with internal OSH policies and procedures, properly using personal protective equipment, attending training sessions, and promptly reporting hazardous situations. Such participation strengthens control mechanisms and contributes to the continuous improvement of the system.
In this regard, it is important to point out that the effectiveness of the OSH Management System depends on coordination between both parties. Prevention is achieved not only through documented procedures, but also through the development of an organizational culture in which safety is a shared value. When employees understand the risks and actively participate in controlling them, and employers provide the necessary conditions and tools, responsiveness is strengthened and the likelihood of incidents is significantly reduced.
Accordingly, it is essential for companies to promote training, communication, and continuous improvement initiatives, ensuring that both employers and employees understand their responsibilities and act in a coordinated manner. Preventive management must remain dynamic and adapt to changes in operations, technologies, and working conditions.
